These Terms of Service ("Terms") govern your access to and use of Action Figure Me, available at actionfigureme.net (the "Service"), operated by Vinicius Sucupira ("we", "us", or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Description of the Service
Action Figure Me lets you upload a photo, choose a name and a visual style, and generates a collectible action-figure-style image using Google's Gemini image model. Each generated image is a one-time paid purchase; there is no subscription.
2. Purchases and Payment
Each generation costs a one-time fee of USD 2.99, charged before the image is generated. Payments are processed by Paddle.com Market Limited ("Paddle"), which acts as our reseller and merchant of record for all purchases. Paddle handles billing and taxes and appears as the merchant on your payment statement. Billing and payment-method terms are also subject to Paddle's own terms.
3. Your Content
You must only upload photos you own or have permission to use, and you must not upload photos of anyone else without their consent. You retain ownership of the photo you upload and of the image generated for you. You grant us a limited license to process your photo and the name you provide solely to generate that image.
4. Acceptable Use
You agree not to use the Service to upload photos of minors in an inappropriate context, upload content you do not have rights to, generate illegal, harmful, or infringing content, or abuse, overload, or interfere with the Service.
5. Disclaimer of Warranties
The Service is provided "as is" and "as available." Generated images are produced by artificial intelligence and may not match your expectations. We do not warrant that the Service will be uninterrupted or error-free, or that outputs will meet your requirements. To the fullest extent permitted by law, we disclaim all warranties, express or implied.
6. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three months before the claim, or USD 2.99, whichever is greater.
7. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Service after changes take effect means you accept the updated Terms.
8. Governing Law
These Terms are governed by the laws of Brazil, without regard to conflict-of-law rules, except where applicable consumer-protection law requires otherwise.
